This Policy is formulated by FLASHMUNK (hereinafter referred to as “the Website”) to strictly comply with the anti-money laundering (AML), anti-telecom and online fraud-related laws, regulations and regulatory requirements in various regions around the world, including but not limited to China’s Measures for the Supervision and Administration of Non-Bank Payment Institutions, the EU MiCA Framework, the relevant regulations of the U.S. FinCEN, and the regulatory requirements of Singapore’s MAS. It aims to prevent and curb money laundering, fraud and other illegal and criminal activities conducted through the Website’s game recharge services, protect the legitimate rights and interests of the Website, users and third-party payment institutions, and maintain financial order and network security. This Policy applies to all users (including registered users and guests) who use the Website’s services, the Website’s operation team and relevant cooperative parties.

I. Core Principles and Responsibility Statement

  1.   1.   3. Applying for a full refund immediately after recharge, or conducting multiple recharges and multiple refunds in a short period of time with abnormal transaction behaviors;
  4. For cross-border recharges, the region of fund source and the user’s registration region are inconsistent with the game operation region, and no reasonable explanation can be provided;
  5. Evading the verification requirements for large-value recharges by splitting multiple small-value recharges to complete large-value fund transfers;
  6. The source of recharge funds is unknown, or the user cannot explain the legality of the funds.

For the abnormal transactions detected, the Website will take the following disposal measures:

  1. Suspend the relevant recharge transactions and verify the transaction behaviors;
  2. Notify the user to supplement and submit supporting materials for the rationality of the transaction and the legality of the funds;
  3. If it is verified that the transaction is suspected of money laundering, immediately terminate the relevant services, freeze the involved transaction funds (if necessary), and timely report the Suspicious Activity Report (SAR) to the local financial regulatory authorities and law enforcement agencies in accordance with regulatory requirements and the agreement of third-party payment institutions;
  4. Retain records related to abnormal transactions, including transaction time, amount, payment account, IP address, device information, etc., for a retention period that meets regulatory requirements (not less than 5 years).

(III) Virtual Asset and Fund Management

  1. The Website clearly stipulates that virtual assets such as virtual currency and game points purchased through game recharges can only be used for in-game consumption supported by the Website, and cannot be withdrawn, converted into legal tender, or transferred to other third parties, so as to prevent virtual assets from being used as money laundering tools.
  2. The Website strictly standardizes the fund flow process in accordance with the fund management requirements of third-party payment institutions, ensures that the recharge funds are used exclusively for their intended purposes, and shall not misappropriate, occupy or borrow users’ recharge funds to ensure fund safety.

  1. Impersonating the Website’s customer service or the official game customer service to induce users to recharge and transfer funds to defraud users’ property;
  2. Using fake game accounts or fake recharge links to induce users to recharge, and failing to provide corresponding virtual assets or directly disappearing after recharge;
  3. Inducing users to conduct large-value recharges in the name of “low-price recharge”, “high rebate”, “recharge to unfreeze account”, etc., to implement fraud;
  4. Stealing others’ accounts and payment accounts to recharge through the Website and transfer stolen funds;
  5. Minors making large-value recharges without the consent of their guardians by using their guardians’ payment accounts, and the guardians raise objections and verify the situation.

For the identified fraud behaviors and related complaints, the Website will take the following disposal measures:

  1. Immediately suspend the relevant user accounts and recharge functions, and verify the authenticity of the transactions and relevant evidence;
  2. Actively cooperate with the investigations of users, guardians and law enforcement agencies, and provide relevant transaction records and user information (within the legally providable scope);
  3. If it is verified that there is a fraud behavior, immediately terminate the service agreement with the involved user, freeze the involved account and relevant transaction funds, assist the victim in recovering losses (if necessary), and report the involved information to the law enforcement agencies;
  4. Block the IP addresses, device information and payment accounts suspected of fraud, and prohibit them from using the Website’s services again.

(III) Third-Party Cooperation Prevention and Control

  1. The Website only cooperates with third-party payment institutions with legal qualifications and compliant risk control capabilities, signs compliant cooperation agreements, clarifies the anti-fraud responsibilities of both parties, and requires third-party payment institutions to provide transaction risk control support to jointly intercept fraudulent transactions.
  2. Any unauthorized third-party recharge agency behavior is prohibited, including but not limited to users purchasing recharge services from third-party recharge platforms, entrusting third parties to recharge on their behalf, providing game accounts for third-party devices to log in and recharge, etc., to prevent fraud risks caused by third-party recharge agency.

IV. User Compliance Obligations

All users who use the Website’s recharge services shall strictly fulfill the following compliance obligations:

  1. Ensure that their identity information is true, accurate and complete, and shall not use false identity information to register accounts or conduct recharges, nor use others’ identity information or payment accounts to conduct recharges;
  2. Ensure that the source of recharge funds is legal, and shall not use funds obtained from illegal and criminal activities such as money laundering, fraud, gambling and illegal fund-raising to conduct recharges;

V. Liability for Violations and Penalties

  1. If a user violates this Policy and relevant laws and regulations, and engages in irregular behaviors such as money laundering, fraud, impersonating others’ identity, and using illegal funds for recharges, the Website has the right to take the following penalty measures (including but not limited to): suspending recharge services, freezing user accounts, freezing transaction funds, canceling relevant transactions, terminating the service agreement, and not refunding the recharged amount;
  2. If a user’s irregular behavior leads to illegal crimes, the Website will immediately report it to the local law enforcement agencies and financial regulatory authorities, and cooperate in investigating the user’s criminal liability and administrative liability; if any loss is caused to the Website, third-party payment institutions or other users, the user shall bear full compensation liability;
  3. If an employee of the Website’s operation team violates this Policy, fails to perform compliance duties, and engages in behaviors such as dereliction of duty, malfeasance and collusion in irregularities, the Website will impose penalties in accordance with internal management systems; if it involves illegal activities, it will be transferred to the law enforcement agencies for handling.

VI. Policy Update and Disclosure

  1. The Website will regularly revise and improve this Policy in accordance with the updates of anti-money laundering and anti-fraud related laws and regulations in various regions around the world, as well as the compliance requirements of third-party payment institutions and changes in industry risks. The revised Policy will be announced in a prominent position on the Website’s homepage, and will take effect on the date of announcement, without separately notifying users;
  2. Users shall regularly check this Policy. If users continue to use the Website’s services, it shall be deemed that they have read, understood and agreed to the revised Policy; if users disagree with the revised Policy, they shall immediately stop using the Website’s services;
  3. The final interpretation right of this Policy belongs to FLASHMUNK. If users have any questions about this Policy, they can consult through the Website’s customer service channels.
