欢迎访问FLASHMUNK平台(包括网站https://www.flashmunk.com及移动应用程序,以下简称“平台”)。本销售条款(以下简称“本条款”)适用于您(以下简称“买家”)通过本平台购买任何商品或服务(以下统称“商品”,包括但不限于游戏卡、礼品卡、游戏充值服务、数字游戏等)的所有交易。
订单提交:您通过平台选择商品、填写相关信息并提交订单时,即构成向我们发出的购买要约。您确认,提交订单时所提供的个人信息、付款信息等均真实、准确、完整,且您有权使用所提供的付款方式完成支付。
订单确认:我们有权对您提交的订单进行审核(包括但不限于验证付款信息、商品库存、订单信息完整性等)。仅当我们向您发送订单确认信息(包括但不限于短信、邮件、平台内通知),或完成商品交付(如数字商品的兑换码发送、充值到账)时,您与我们之间的买卖合同方成立并生效。
付款义务:您应在提交订单后,按照平台提示的付款方式及时完成全额付款。如您未在规定时间内完成付款,我们有权取消您的订单,且无需承担任何责任。
付款方式:平台支持的付款方式以页面展示为准,我们可根据业务需要不时调整付款方式,且无需另行通知您。您应确保所使用的付款方式合法有效,如因付款方式问题导致付款失败、延迟到账或产生额外费用,相关责任由您自行承担。
交付方式:根据商品类型不同,我们将采取相应的交付方式: 数字商品(如游戏兑换码、礼品卡、充值服务等):通常通过平台内消息、短信、邮件等方式向您发送兑换码、激活链接或直接完成充值,交付时间一般为付款完成后即时到账,特殊商品的交付时间以商品详情页说明为准;
实体商品(如适用):将通过平台合作的物流服务商配送至您订单中填写的收货地址,配送时间以物流服务商的实际配送进度为准。
交付信息确认:您应确保订单中填写的收货地址、联系方式、接收商品的账号/邮箱等信息准确无误。如因您提供的信息错误导致商品交付失败、延迟或错发,相关损失由您自行承担,我们不承担补发、退款或赔偿责任。
交付风险转移:数字商品一经发送至您指定的接收渠道(如平台消息、短信、邮箱)或完成充值,即视为交付完成,商品的风险及所有权转移至您;实体商品的风险自物流服务商将商品交付给您或您指定的收件人时转移。
数字商品特殊性说明:由于数字商品具有可复制性、一旦交付即无法回收的特性,除以下特殊情况外,所有数字商品一经交付,不支持退换货: 商品本身存在质量问题(如兑换码无效、无法激活,且经我们核实非您操作不当导致);
我们未能按照订单约定交付商品,且在您提出异议后未能在合理期限内完成补交付;
法律法规另有明确规定的情形。
实体商品退换:如您购买的实体商品存在质量问题、错发、漏发等情况,应在收到商品后的7个自然日内联系平台客服,并提供相关凭证(如商品照片、物流面单等),经我们核实后,可根据情况为您办理退换货。退换货产生的物流费用,如因商品质量问题导致,由我们承担;如因您个人原因(如不喜欢、买错等)导致,由您自行承担。
退换货流程:您需在符合退换货条件的情况下,先联系平台客服申请退换货,经审核通过后,按照客服指引办理相关手续。未按规定流程申请且擅自退回商品的,我们有权拒绝接收或不予处理。
您应遵守本条款及平台所有相关规则,合法、合规地使用所购买的商品,不得利用商品从事任何违法、违规或侵犯第三方合法权益的活动。
您应妥善保管所购买商品的相关凭证(如兑换码、订单信息等),如因您自身保管不善导致商品被盗用、泄露,相关损失由您自行承担。
如您在使用商品过程中遇到问题,应及时联系平台客服反馈,不得通过恶意差评、投诉、诋毁等方式影响平台正常运营,否则我们有权追究您的相关责任。
我们应按照本条款约定,向您提供符合商品详情页描述的商品(正常使用损耗除外),并保障平台交易系统的正常运行(不可抗力或第三方原因导致的系统故障除外)。
责任限制:在适用法律允许的最大范围内,我们不对以下情况承担责任: 因不可抗力、第三方服务故障(如支付服务商、物流服务商、网络运营商故障)、您的操作不当或提供的信息错误导致的任何损失;
您因使用商品所产生的间接损失、偶然损失、特殊损失或后果性损失(包括但不限于利润损失、数据损失、商誉损失等);
商品本身存在的第三方知识产权瑕疵(如游戏开发商的版权问题),但我们在知晓该瑕疵后应及时协助您与相关方沟通解决。
平台信息仅供参考:平台上展示的商品图片、描述、价格等信息均为参考,如因系统更新、商品批次差异等原因导致信息存在微小误差,不构成违约,我们将在发现后及时更正;如误差较大影响您的购买决策,您可选择取消订单(未付款订单)或按照本条款退换货政策处理(已付款订单)。
平台上所有的商标、标识、文字、图片、软件等知识产权均归我们或相关权利人所有,未经我们或相关权利人书面许可,您不得擅自使用、复制、传播或用于其他商业目的。
您购买商品后,仅获得商品的使用权,商品所涉及的著作权、商标权等知识产权仍归商品的原始权利人(如游戏开发商、发行商等)所有,您不得侵犯相关权利人的知识产权。
本条款受马来西亚法律管辖并据其解释,不考虑冲突法或法律选择原则。
因本条款引起或与本条款相关的任何争议、纠纷,双方应首先通过友好协商解决;协商不成的,任何一方均有权向马来西亚有管辖权的法院提起诉讼。
我们有权根据业务发展需要不时修订本条款,修订后的条款将在平台上发布公示,并在公示后生效。如您继续使用平台服务并进行购买,即视为接受修订后的条款;如您不接受,应停止使用平台服务。
本条款的任何条款被认定为无效、可撤销或不可执行,不影响其他条款的效力,其他条款仍应继续履行。
您与我们之间的任何通知、沟通,可通过平台内消息、邮件、短信等方式进行,通知一经发送至您指定的联系方式,即视为送达。

Welcome to the FLASHMUNK Platform (including the website https://www.flashmunk.com and mobile applications, hereinafter referred to as the "Platform"). These Terms of Sale (hereinafter referred to as the "Terms") apply to all transactions in which you (hereinafter referred to as the "Buyer") purchase any goods or services (collectively referred to as the "Items" hereinafter, including but not limited to game cards, gift cards, game top-up services, digital games, etc.) through the Platform.
Submission of Orders: When you select Items, fill in relevant information and submit an order through the Platform, you are making an offer to purchase from us. You confirm that all personal information, payment information, etc. provided when submitting the order are true, accurate and complete, and that you have the right to use the provided payment method to complete the payment.
Confirmation of Orders: We reserve the right to review your submitted order (including but not limited to verifying payment information, Item inventory, completeness of order information, etc.). The sales contract between you and us shall only be established and effective when we send you an order confirmation message (including but not limited to SMS, email, in-Platform notification) or complete the delivery of the Items (such as sending the redemption code of digital Items or completing the top-up).
Payment Obligation: You shall promptly complete the full payment in accordance with the payment method prompted by the Platform after submitting the order. If you fail to complete the payment within the specified time, we reserve the right to cancel your order without assuming any liability.
Payment Methods: The payment methods supported by the Platform are subject to the display on the page. We may adjust the payment methods from time to time according to business needs without prior notice to you. You shall ensure that the payment method used is legal and valid. If payment failure, delayed arrival of funds or additional fees occur due to problems with the payment method, the relevant liability shall be borne by you.
Delivery Methods: Depending on the type of Items, we will adopt corresponding delivery methods: Digital Items (such as game redemption codes, gift cards, top-up services, etc.): Usually, the redemption code, activation link will be sent to you via in-Platform messages, SMS, email, or the top-up will be completed directly. The delivery time is generally immediate after the payment is completed. The delivery time of special Items is subject to the description on the Item details page;
Physical Items (if applicable): Will be delivered to the shipping address filled in your order by the logistics service provider cooperating with the Platform. The delivery time is subject to the actual delivery progress of the logistics service provider.
Confirmation of Delivery Information: You shall ensure that the shipping address, contact information, account/email for receiving Items and other information filled in the order are accurate and correct. If the delivery of Items fails, is delayed or is incorrectly delivered due to incorrect information provided by you, the relevant losses shall be borne by you, and we shall not be liable for reissuing, refunding or compensating.
Transfer of Delivery Risk: For digital Items, once sent to your designated receiving channel (such as in-Platform messages, SMS, email) or the top-up is completed, the delivery shall be deemed completed, and the risk and ownership of the Items shall be transferred to you; the risk of physical Items shall be transferred when the logistics service provider delivers the Items to you or the recipient designated by you.
Special Note on Digital Items: Due to the replicability of digital Items and the inability to recover them once delivered, all digital Items are not eligible for return or refund once delivered, except for the following special circumstances: The Item itself has quality problems (such as invalid redemption code, inability to activate, and verified by us that it is not caused by your improper operation);
We fail to deliver the Items in accordance with the order agreement, and fail to complete the supplementary delivery within a reasonable period after you raise an objection;
Circumstances explicitly stipulated by laws and regulations.
Return and Refund of Physical Items: If the physical Items you purchased have quality problems, incorrect delivery, missing delivery, etc., you shall contact the Platform customer service within 7 natural days after receiving the Items and provide relevant certificates (such as Item photos, logistics waybill, etc.). After verification by us, we may handle the return or refund for you according to the situation. The logistics costs incurred for return and refund shall be borne by us if caused by quality problems of the Items; if caused by your personal reasons (such as dislike, wrong purchase, etc.), shall be borne by you.
Return and Refund Process: You need to contact the Platform customer service to apply for return or refund first if you meet the return and refund conditions. After the application is approved, follow the instructions of the customer service to complete the relevant procedures. We reserve the right to refuse to accept or not handle the Items returned without applying in accordance with the specified process and returning the Items without authorization.
You shall comply with these Terms and all relevant rules of the Platform, use the purchased Items legally and in compliance with regulations, and shall not use the Items to engage in any illegal, irregular or activities that infringe the legitimate rights and interests of third parties.
You shall properly keep the relevant certificates of the purchased Items (such as redemption codes, order information, etc.). If the Items are stolen or leaked due to your improper storage, the relevant losses shall be borne by you.
If you encounter problems in using the Items, you shall promptly contact the Platform customer service for feedback. You shall not affect the normal operation of the Platform through malicious negative reviews, complaints, slander, etc., otherwise we reserve the right to pursue your relevant liabilities.
We shall provide you with Items that conform to the description on the Item details page (except for normal use wear and tear) in accordance with the agreement of these Terms, and ensure the normal operation of the Platform transaction system (except for system failures caused by force majeure or third-party reasons).
Limitation of Liability: To the fullest extent permitted by applicable law, we shall not be liable for the following situations: Any losses caused by force majeure, third-party service failures (such as failures of payment service providers, logistics service providers, network operators), your improper operation or incorrect information provided;
Indirect, incidental, special or consequential losses (including but not limited to loss of profits, loss of data, loss of goodwill, etc.) incurred by you due to the use of the Items;
Third-party intellectual property defects of the Items themselves (such as copyright issues of game developers), but we shall promptly assist you in communicating with relevant parties to resolve the issue after knowing the defect.
Platform Information for Reference Only: The Item pictures, descriptions, prices and other information displayed on the Platform are for reference only. If there are minor errors in the information due to system updates, differences in Item batches, etc., it shall not constitute a breach of contract, and we will correct them in a timely manner after discovery; if the error is large enough to affect your purchase decision, you may choose to cancel the order (unpaid order) or handle it in accordance with the return and refund policy of these Terms (paid order).
All trademarks, logos, texts, pictures, software and other intellectual property rights on the Platform are owned by us or the relevant right holders. Without the prior written permission of us or the relevant right holders, you shall not arbitrarily use, copy, disseminate or use them for other commercial purposes.
After purchasing the Items, you only obtain the right to use the Items. The copyright, trademark right and other intellectual property rights involved in the Items still belong to the original right holders of the Items (such as game developers, publishers, etc.). You shall not infringe the intellectual property rights of the relevant right holders.
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to conflict of laws or choice of law principles.
Any disputes or controversies arising out of or in connection with these Terms shall first be resolved through friendly negotiation between the parties; if negotiation fails, either party shall have the right to file a lawsuit with the competent court in Malaysia.
We reserve the right to revise these Terms from time to time according to business development needs. The revised Terms will be posted and announced on the Platform and will take effect after the announcement. If you continue to use the Platform services and make purchases, it shall be deemed that you accept the revised Terms; if you do not accept, you shall stop using the Platform services.
If any term of these Terms is deemed invalid, revocable or unenforceable, it shall not affect the validity of other terms, and the other terms shall continue to be performed.
Any notices or communications between you and us may be conducted through in-Platform messages, emails, SMS, etc. A notice shall be deemed delivered once it is sent to your designated contact method.
These Terms constitute the entire agreement between you and us regarding the sale of Items on the Platform, replacing any oral or written agreements or understandings reached by the parties on relevant matters prior to this.
